Terms of Service
Effective date: August 2025
These Terms of Service (“Terms”) are a legal agreement between you and BizTri LLC (“BizTri,” “we,” “us,” or “our”) that govern your access to and use of our websites, interactive forms, booking pages, chat/automations, and related offerings (the “Services”). By accessing or using the Services, you agree to these Terms. If you’re entering into these Terms on behalf of a company or organization, you represent that you have authority to bind that entity.

1) Scope & account
- Eligibility. You must be at least 18 and legally able to enter contracts.
- Account & accuracy. If an account or intake is used, you agree to provide accurate info and keep it updated.
- Authorized users. You’re responsible for actions taken via your access and for keeping access credentials secure.
2) Plans, pricing & billing
- Packages. We offer plans such as Essential, Growth, and Scale, as well as Custom projects. Features are described on our Packages page and may evolve over time.
- Founders’ pricing & commitment. Early-adopter (“Founders’”) pricing typically requires a 6-month commitment. Month-to-month pricing may differ.
- Setup fees. Growth & Scale may include a one-time setup/onboarding fee for integrations and custom workflows.
- Billing. Unless otherwise agreed, subscriptions are billed in advance and renew automatically each billing cycle until canceled as described below.
- Taxes. Prices exclude applicable taxes; you’re responsible for any required taxes, duties, or government charges.
- Refunds. Subscription and setup fees are generally non-refundable once work has begun, except where required by law or expressly stated in your order form or SOW.
3) Cancellations, upgrades & changes
- Cancellation. You may cancel future renewals at any time, effective at the end of the current paid term. If you received Founders’ pricing with a required term, cancellation takes effect after that minimum term ends.
- Upgrades/downgrades. Changes take effect at the next billing cycle unless otherwise agreed; pro-rations may apply.
- Changes to Services or pricing. We may change features or pricing with reasonable notice. If you object to a material adverse change, you may cancel before the change takes effect.
4) Your content & data
- Your responsibility. You’re responsible for content you provide (text, files, training data, brand assets, etc.) and must ensure you have rights to use it and to grant us the rights below.
- License to operate the Services. You grant BizTri a non-exclusive, worldwide, royalty-free license to host, process, and use your content solely to provide and improve the Services and to fulfill your requests (e.g., setting up automations, building funnels, configuring chatbots, analytics, and integrations).
- Customer data processing. For data we process on your behalf about your clients or end users, we act as your processor; you are the controller. Our processing will follow your instructions and our agreement with you. See our Privacy Policy for more detail.
- No training of public models. Unless we have your written permission, your customer data is not used to train public/shared AI models.
- Data sources. You understand that using third-party sources (e.g., your site, CRM, ad accounts) may import or sync data. You are responsible for obtaining necessary consents.
5) Acceptable use
You agree not to misuse the Services. Prohibited activities include (without limitation):
- Illegal activities, harassment, discrimination, or violations of others’ rights.
- Uploading content you don’t have rights to, or that is defamatory, obscene, or deceptive.
- Attempting to bypass security, reverse engineer, or interfere with the Services.
- Sending spam, unlawful calls/SMS, or violating platform rules (e.g., Google/Meta/Cal.com/CRM terms).
- Using the Services for high-risk scenarios where errors could lead to death, personal injury, or severe property/environmental damage.
We may suspend or terminate access for violations.
6) Third-party services
The Services may integrate with tools you authorize (e.g., Cal.com, n8n, HubSpot, Airtable, email/SMS, analytics, ads platforms). Your use of those tools is governed by their terms and privacy notices. We are not responsible for third-party services.
7) Intellectual property
- Our IP. The Services, site design, software, documentation, and content we provide are owned by BizTri or our licensors and are protected by law. No rights are granted except as expressly set out in these Terms.
- Deliverables. For custom projects, ownership and license of deliverables (copy, designs, automations, prompts, templates) are as specified in your order/SOW. Unless otherwise agreed, we grant you a non-exclusive license to use deliverables for your internal business purposes while you are a paying customer.
- Feedback. If you provide ideas or suggestions, you grant us a free, perpetual license to use them without restriction.
8) Marketing & publicity
We may identify you as a customer (name and logo) in listings and case studies, unless you opt out by emailing support@biztriai.com. We’ll seek consent for any sensitive details.
9) Confidentiality
Each party may receive confidential information from the other. The receiving party will use it only to perform under these Terms and will protect it with reasonable care. Confidentiality obligations do not apply to information that is public, already known, independently developed, or rightfully received from a third party.
10) Security & data privacy
We use reasonable technical and organizational measures to protect personal information. No method is 100% secure. Our privacy practices are described in our Privacy Policy.
11) Disclaimers
- No guaranteed results. We provide tools, systems, guidance, and implementation. Outcomes depend on your industry, budget, offers, and execution. We do not guarantee leads, revenue, or specific business results.
- As-is / as-available. Except as expressly stated, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory (including merchantability, fitness for a particular purpose, and non-infringement).
- Beta features. Betas or previews may be offered without support and may change at any time.
12) Limitation of liability
To the fullest extent permitted by law, BizTri and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption, even if advised of the possibility. Our aggregate liability for all claims relating to the Services will not exceed the greater of (i) amounts paid by you to BizTri during the 3 months prior to the event giving rise to liability, or (ii) USD $500. Some jurisdictions don’t allow certain limitations; in that case those limits apply to the maximum extent permitted.
13) Indemnification
You will defend, indemnify, and hold harmless BizTri and its affiliates from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the Services, or your violation of these Terms or applicable law.
14) Suspension & termination
We may suspend or terminate access if you breach these Terms, fail to pay, or create security/operational risks. Upon termination, your right to use the Services stops; certain sections survive (e.g., fees owed, confidentiality, IP ownership, disclaimers, limitations, and dispute resolution).
15) Dispute resolution; governing law
- Informal resolution. Before filing a claim, each party will try to resolve the dispute in good faith within 30 days after notice.
- Arbitration. Except for small-claims matters or injunctive relief, disputes will be resolved by binding, individual arbitration under the rules of the American Arbitration Association. Class actions are waived.
- Governing law & venue. These Terms are governed by the laws of the Florida, without regard to conflicts of law. Venue for any permitted court action is the state or federal courts located in that state, and both parties consent to jurisdiction there.
16) Miscellaneous
- Notices. We may send notices to the email you provide; you may contact us at support@biztriai.com.
- Entire agreement. These Terms, together with any order forms or statements of work, are the entire agreement and supersede prior agreements on the subject.
- Changes to Terms. We may update these Terms; when we do, we’ll post the new version with an updated date. Material changes will be notified with reasonable advance notice. If you continue using the Services after the effective date, you accept the changes.
- Assignment. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger or sale.
- Force majeure. Neither party is liable for delays or failures due to events beyond reasonable control.
- Severability; waiver. If a provision is unenforceable, the remainder stays in effect. A waiver must be in writing and is not a continuing waiver.
