BizTri LLC (“BizTri,” “we,” “us”) provides installation, configuration, and ongoing optimization of the TriForge™ system for U.S.-based service businesses (e.g., HVAC, plumbing, electrical, roofing). The system includes the TriForge™ Growth Engine (Core), optional TriForge™ AI Assistant (Voice/Chat), and optional TriForge™ Beacon (social & reactivation), together with dashboards, forms/funnels, messaging automations, scheduling, and reporting (collectively, the “Services”).
Scope & Permitted Use. The Services are licensed for the Client’s internal business use only. They may not be resold, sublicensed, or used to provide competing automation, marketing, or AI services to others. Custom features, data flows, and automations delivered by BizTriAI remain proprietary to BizTriAI.
Plans are summarized below as Exhibit A — Plans, Pricing & Commitments. Each Client’s order form or invoice specifies their selected plan, setup fee, and any special terms, which are incorporated by reference.

Founders’ Cohort. Pricing and setup fee are determined individually at or after the onboarding meeting and documented in writing. Founders receive early-access pricing or complimentary service in exchange for participation feedback, testimonial rights, and direct strategy sessions. This section authorizes BizTriAI to set such variable or waived pricing case-by-case.
Plan components and prices may change prospectively with notice. Any local taxes, carrier fees, or platform pass-through costs are additional.
Subscriptions are billed monthly in advance and auto-renew until canceled. Setup fees are one-time and due when you order. We use Stripe to process payments; by subscribing you authorize recurring charges to your payment method on file. Late or failed payments may result in suspension or termination after notice.
Exclusive remedies: The make-goods above are your sole and exclusive remedies for the covered issues. They require your reasonable cooperation, timely access, and accurate data.
Month-to-month terms. You may cancel anytime; cancellation takes effect at the end of your then-current paid period. We do not provide refunds except as expressly stated in Section 4.
We use carriers and platforms to deliver messages (e.g., Telnyx for SMS). You remain the sender of record. You agree to maintain opt-in/opt-out processes, honor STOP/HELP keywords, and respect quiet hours where required. Carrier surcharges and registration fees (e.g., 10DLC) may apply and are your responsibility.
The Services include AI-generated suggestions and content (scripts, emails, ads, social posts, call handling, etc.). BizTri accepts responsibility for AI outputs it generates or deploys on your behalf, subject to the Limitation of Liability in Section 16. You agree to promptly notify us of any harmful, inaccurate, or non-compliant outputs so we can remediate under the Fix-in-48h commitment. We are not responsible for platform outages, carrier blocking, or 3rd-party changes.
You authorize us to access/manage your social pages, Google Business Profile/listings, and ad accounts solely to deliver the Services. You remain the owner of your accounts and content; you can revoke our access at any time (revocation may affect delivery).
Support via email at support@biztriai.com. We aim to meet the Fix-in-48h commitment for issues within the Engine. Service levels exclude force majeure and third-party/platform outages.
We grant you a non-exclusive, non-transferable license to use the configured workflows, templates, and assets during your active subscription. Our pre-existing IP, libraries, and methods remain exclusively ours. You own your first-party data, brand assets, and approved outputs.
We treat your non-public information as confidential and use it only to provide the Services. For your end-customer data, we act as your processor and will process that data solely on your documented instructions, implement reasonable safeguards, and delete or return it upon request, subject to legal retention requirements.
The Services integrate with third parties you may use or that we use to deliver features. Key providers presently include: Telnyx (telephony/SMS), Cal.com (scheduling), n8n (automation/orchestration), and Stripe (payments). These providers are independent controllers/processors under their own terms and privacy policies. We may replace or add providers over time.
Upon termination, BizTriAI will, on request, export or provide reasonable access to Client’s leads and configuration data within ten (10) business days. After sixty (60) days, BizTriAI may delete or anonymize remaining data except for archival or legal purposes. Client remains responsible for retrieving any required data before closure of the account.
BizTriAI may modify, upgrade, or replace portions of the Services or third-party integrations from time to time. Material changes that materially reduce functionality will be communicated in advance, and Client may terminate without penalty if such changes materially impair delivery.
Except for the express guarantees in Section 4, the Services are provided “as-is.” We do not promise a specific revenue amount or market share; results vary by market, offer, budget, and execution.
To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost profits, revenue, goodwill, or data. BizTri’s total aggregate liability for all claims (including for AI outputs) will not exceed the amounts you paid to BizTri in the 12 months preceding the event giving rise to liability. Nothing limits liability for willful misconduct or amounts payable under a defense/indemnity obligation above.
Each party acknowledges that the fees reflect this allocation of risk and limitation of liability.
Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the Federal Arbitration Act, administered by AAA or JAMS under their Commercial Rules. The arbitration may be conducted remotely (videoconference) or in Florida. The arbitrator may award individual relief as permitted by law.
Class/Representative Action Waiver. Proceedings must be on an individual basis; class, collective, or representative actions are not permitted. Jury trial is waived. Either party may bring a qualifying individual claim in small-claims court.
Florida law governs, without regard to conflict-of-law rules, except that the FAA governs arbitration.
We may update these Terms prospectively. Material changes will be communicated and posted with a new effective date.
Force majeure applies. Neither party may assign without consent (except a successor in interest). Notices may be sent to your account email and to support@biztriai.com. If any provision is unenforceable, the remainder stays in effect.
Security Responsibilities. BizTriAI implements reasonable administrative, technical, and organizational measures to protect data. Client is responsible for securing its own passwords, API keys, and account access credentials.
Entire Agreement. This document and any accompanying order form or invoice constitute the entire agreement between the parties regarding its subject matter and supersede all prior agreements or understandings (oral, written, electronic) relating to its subject matter.
This Policy covers U.S. activities only. For BizTri’s own website leads and business contacts, BizTri is a controller. For data from your customers that we process to provide the Services (calls, chats, bookings, messages), BizTri acts as your processor.
We do not sell personal information and we do not use your end-customer data for BizTri’s own marketing. We share data with service providers under contract to deliver features, including:
We may add or replace providers as the Services evolve; we will update this page or provide notice where required.
We use necessary cookies for security/session and may use analytics/advertising cookies. You can control cookies in your browser; some features may not work if disabled.
With your direction, we send messages to your contacts. Standard carrier rates apply. Recipients may reply STOP to opt out and HELP for help. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We implement reasonable technical and organizational safeguards appropriate to the risk. No method of transmission or storage is 100% secure.
We retain personal data for up to 24 months to provide and improve the Services, or longer if required by law, then delete or de-identify it. You may request earlier deletion where applicable.
You may opt out of BizTri marketing emails at any time. Depending on your state, you may have rights to access, correct, delete, or obtain a copy of personal information we hold as a controller. Submit requests to support@biztriai.com. We will not discriminate for exercising your rights.
Our Services are intended for the U.S. If data is transferred across borders, we apply appropriate safeguards consistent with applicable U.S. law.
Our Services are not directed to children under 13.
